Sexual Abuse in Pittsburgh
Every nine minutes, a child in the United States experiences sexual abuse. Survivors of childhood sexual assaults often endure lifelong challenges, including emotional and psychological struggles. Statistics show that survivors of such abuse are:
- Four times more likely to struggle with substance abuse.
- Four times more likely to experience symptoms resembling PTSD as adults.
- Three times more likely to go through a major depressive episode in adulthood.
Where Does Sexual Abuse Happen?
Most minor sexual assault victims are harmed by someone they know. These incidents take place across a variety of locations, including:
- Scout meetings and camping events
- Sports facilities and gyms
- Daycare centers
- Churches and other religious venues
- Healthcare facilities
- Schools and academic environments
- Summer camps
Unfortunately, many organizations serving children fail to implement adequate screening measures for their employees and volunteers, which leaves children vulnerable to abuse.
Classifications of Sexual Abuse in Pittsburgh
Under Pittsburgh law, child sexual abuse involves any unlawful act where an adult or older adolescent exploits a child for their own sexual gratification. Types of child sexual abuse include:
- Fondling and other forms of molestation
- Grooming behaviors aimed at gaining a child’s trust
- Physical sexual contact of any kind
- Indecent exposure
- Obscene phone calls, text messages, or digital interactions
- The creation or distribution of child pornography
Sexual abuse doesn’t have to involve physical contact. It can include exposing a child to explicit materials or communication designed to fulfill a perpetrator’s gratification.
Pittsburgh Statute of Limitations for Sexual Abuse Cases
Filing Deadlines for Childhood Sexual Assault Cases
The standard statute of limitations for personal injury claims in Pittsburgh is two years. However, this brief timeframe has proven unfair for many victims of child sexual abuse. Survivors often repress memories of their traumatic experiences, sometimes for decades, and symptoms or awareness of harm frequently don’t arise until adulthood.
Recognizing these challenges, Pittsburgh updated its statute of limitations in 2020. Survivors of childhood sexual abuse may now file a civil lawsuit until they turn 36. This reform applies to all survivors who were under 36 when the law was enacted.
Four-Year Discovery Rule for Abuse Cases
For individuals of any age, Pittsburgh also applies a four-year “discovery rule.” This rule states that survivors have four years to file a lawsuit after discovering an injury related to past abuse. For example, if a person older than 36 begins to recall repressed memories of abuse or realizes the abuse caused harm only years later, they may still have the legal right to pursue an action.
Taking the First Step with Your Abuse Allegations
At Logue Law Group, we understand how difficult it is for survivors to come forward with allegations of sexual abuse. Still, we believe every victim deserves closure and justice.
