Starting August 2017, Pennsylvania implemented a groundbreaking change targeting first-time DUI offenders. Under the updated laws, first-time offenders are now required to install ignition interlock devices in their vehicles. These devices measure Blood Alcohol Content (BAC) through a breath test before allowing the vehicle to start.
Here are the key details:
- Device Requirements: The ignition interlock device measures the driver’s BAC and prevents the vehicle from starting if the level exceeds the legal limit of 0.08%. For accuracy, multiple attempts are allowed, but repeated high readings result in lockout periods (five minutes after the first try, 30 minutes after a second failed attempt).
- Costs: Offenders bear the device’s installation and maintenance costs, amounting to approximately $100 per year.
- Driving Privileges: With an ignition interlock license, first-time offenders can drive to work and other permitted locations. The device must remain installed for one year, and only PennDOT-certified mechanics are authorized to handle the installation.
Previously, first-time DUI offenders faced an automatic one-year driver’s license suspension. The new law offers an alternative for those who refuse a blood-alcohol test during their first offense. Instead of a complete suspension, these individuals may opt for the ignition interlock device after serving a reduced six-month suspension.
The legislation also introduces random “rolling re-tests,” which require drivers to provide a breath sample while the car is in motion to deter attempts at manipulating the system. Initially reserved for repeat offenders, ignition interlock devices are now a mandatory tool for first-time DUI charges.

July 1, 2019 – Severe Penalties for Repeat and Fatal DUI Offenses
Effective December 23, 2018, Pennsylvania further escalated the consequences for repeat DUI offenders and for those involved in severe cases such as fatalities. These stricter measures emphasize the state’s commitment to curbing dangerous driving behaviors.
Key updates include:
- Felony Charges for High-DUI Offenses: A third offense involving a BAC of 0.16% or higher (High-DUI category) now carries felony-level consequences. The same applies to a fourth or subsequent offense.
- Fatal DUI Incidents: A DUI-related fatality results in a first-degree felony charge and an additional five years of prison time.
- Aggravated Assault: Aggravated assaults while driving under the influence now carry extended sentences, with two additional years of imprisonment for these offenses.
- Driving Under Suspension:
- First Offense: A minimum fine of $500 and up to 60 days in jail.
- Second Offense: A mandatory minimum of 90 days in jail and a $1,000 fine.
